Criminal Investigation to Prosecution
Any criminal case begins with an investigation. The federal government has many different investigatory agencies. From the IRS to the FBI, each different agency is tasked with protecting United States citizens from different kinds of criminal activity. Once a special agent has investigated a case, the investigatory agency will turn the case over to the U.S. Attorney’s Office for prosecution by the Department of Justice (DOJ).
Magistrate and District Court Judges
A magistrate judge works for the federal district court judges. A magistrate judge will conduct the preliminary proceedings in a criminal case as delegated by the district court judge and handle misdemeanor cases. They may handle bail and arraignment proceedings or any pretrial motion as directed by the federal district court judge. A federal district court judge is appointed by the President of the United States and is appointed for life. A federal district court judge will oversee a wide range of cases, including:
- White-collar crime matters
- Drug trafficking or distribution
- Federal firearms and weapons charges
- Healthcare fraud cases
A federal district court judge will also handle the sentencing proceedings once a criminal has been convicted of a crime.
