- Conspiracy in the first degree (class A-I felony) requires that you are at least 18 years of age and devised a plan with one or more persons under the age of 16 to commit the “alleged” offense.
- Even if the act itself was not fulfilled, some overt conduct may suggest you were conspiring with another person.
Conspiracy Penalties
A first-degree conspiracy offense carries a sentence of life in prison. Still, a conspiracy in the sixth degree involves a 90-day prison sentence, probation of up to one year, and a potential fine.
Under 18 U.S.C. §371, a person who conspires to commit an offense or defraud the United States or any federal agency is guilty of federal conspiracy. Under federal law, you may be imprisoned for five years, fined, or both imprisoned and fined.
