Federal Penalties for Fraud
Sentencing for a federal offense is based upon the Federal Sentencing Guidelines issued by the United States Sentencing Commission. Since the guidelines consider several factors that relate to the seriousness of your offense, minimum sentences are often longer than if you were convicted in state court.
Let us examine specific charges and minimum penalties under federal law:
Bank Fraud
Maximum of 30 years in prison and $1 million in fines.
Healthcare Fraud
The fine levied reflects the value of the services deceptively received or claimed. Additionally, an offender may be imprisoned anywhere from 10 years to life. Both incarceration and fines may be imposed.
Mail or Wire Fraud
Maximum of 20 years in prison, fined, or potentially both. If the fraud targeted a financial institution or a presidentially declared major disaster or emergency fund, you may be sentenced to up to 30 years in prison, fined $1 million, or potentially both.
Securities and Commodities Fraud
Under 18 U.S.C. §1348, the court may impose a fine based on the amount of money that was stolen. In addition to paying a fine, you may be imprisoned for 25 years or fined and imprisoned.
Tax Fraud
Punishable by three years in prison or individual fines of $100,000 ($500,000 for a corporation), or potentially both, in addition to court-related costs and fees. Additionally, the IRS can seize any assets associated with fraudulent activity.

New York State Penalties for Fraud
If your crime is in violation of the New York Penal Code, you will be prosecuted in state court. While some fraud charges are considered misdemeanors (punishable by a maximum of one year in jail), others are charged as felonies.
For example, the criminal sale of a police uniform is a Class A misdemeanor, punishable by up to one year in prison, probation, a fine of $1,000 (or double what the individual sold the uniform for), or imprisonment and a fine.
In contrast, a person who develops a scheme to steal money, property, or assets from two or more people will be charged with a Scheme to Defraud in the First Degree. This is a Class E felony, punishable by up to four years in prison and a fine of $5,000. Although both fraudulent acts are in violation of the law, the state penal code assigns the two crimes different levels of severity.
